There are many advantages to having a lawyer draft and file your trademark and/or copyright application and/or draft a contract on your behalf. The main reason being, that a lawyer is more likely to prepare a more legally sound application and/or contract; thereby, providing you with broader legal rights and avoiding related pitfalls.
For example, the United States Patent & Trademark Office (USPTO) always tries to keep all trademark classifications narrowly defined, which in turn results in the restriction of your trademark’s scope and rights. Obviously lawyers are trained to word an application and/or contracts in a way that will maximize your trademark rights and/or your contractual rights. Furthermore, an experienced lawyer will know how to avoid the countless of probable mistakes in the selection and preparation of classifications, specimens, application details and/or contractual terms.
But the main reason to hire a lawyer to prepare your trademark and/or copyright application and/or any contract is that “only” a lawyer can give you legal advice. All of those freelance website and do it yourself website, cannot give legal advice as they are not lawyers, and therefore they always include “Disclaimers” clearly stating that they cannot give legal advice and that you should consult a lawyer for same.
If you don't use a lawyer for your trademark and/or copyright registration, and any question and/or problem arises, you will have to retain a lawyer and pay same by the hour for the legal advice. It is very common for the USPTO to issue “Office Actions” (USPTO notices detailing faults, problems and/or flaws in your application). You can get an idea of how often Office Actions are issued by the USPTO, by simple conducting a search via the USPTO website. There are countless of reasons why an Office Action may be issued, including but not limited to similarity of trademarks, similarity of goods and/or services, classification of goods and/or service, and description of goods and/or services.
Having a trademark and/or copyright lawyer file your application ensures that your trademark and/or work is properly registered, so that you can obtain the broadest protection possible and avoid the issuance of Office Actions. Furthermore, if a conflict exists between your trademark and a registered trademark, the USPTO attorney will refuse your application for registration. At that point having an experienced trademark lawyer becomes invaluable as experienced lawyers are very knowledgeable on the current state of the law and can advice you as to your legal options.
