A trademark can be a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the products of one party and distinguishes them from those of other parties. A service mark is the same as a trademark, except that it identifies and distinguishes the source of a "service" rather than a product. The terms "trademark" and "mark" are both used to refer to both trademarks and service marks, and are so used herein.
A common law trademark can be obtained by merely using your trademark, and identifying it as a trademark by using the "TM" symbol along with the associated products and/or services. But, such use provides very little protection. If you want the best protection possible you should register your mark with the United States Patent & Trademark Office ("USPTO").
Many States provide for State trademark registration. Nevertheless, State protections vary, and are generally more protected than common law trademarks, but said protection is limited to the State's boundaries and they do not provide as much protection as a federally registered trademark obtains.
The registration of a trademark with the USPTO, provides for nationwide trademark protection, and that is what people refer to as a registered trademark, and those are the ones that are typically identified with the ® symbol.

In order to avoid having your trademark application denied, a trademark search should be conducted before attempting to file a trademark application.
